This FoneShare Software End User License Agreement (EULA or License or Agreement) is between you (“user” or “licensee”) and FoneShare (“software” or “licensor”). Please do not download, install, copy, or use the Software until you have read and agreed to this Agreement. By installing the Software, you are consenting to be bound by the terms and conditions of this Agreement.
Copyright
This Software is owned by FoneShare. You are not allowed to make any unauthorized copies of the Software. Except as expressly permitted under this EULA, you are not granted any intellectual property rights, title, or interest in the Software. You may not issue any public statements, promotional claims, or representations regarding the Software or the Licensor without obtaining prior written authorization from FoneShare.
License Grant
FoneShare grants the you (an individual) a non-exclusive, non-transferable, revocable, and limited license to use this Software on the number of devices specified in your purchase, each running a validly licensed copy of the operating system compatible with the Software, solely for your personal use or your company’s internal business operations, unless expressly permitted otherwise in this Agreement or a supplemental EULA.
Sharing the Software with others, permitting unauthorized access to the Software, or disclosing its contents violates this License. You may not deploy the Software over a network, distribute it to multiple users, or allow concurrent use unless you have purchased a valid multi-user license from FoneShare prior to such use. FoneShare reserves all rights not explicitly granted to you under this Agreement.
Trial Version
If you have downloaded and/or installed a trial version of the Software, you are hereby granted an evaluation license for this Software. Any Free Feature may change into a Paid Feature at any time without notification in advance.
Software Updates
FoneShare is committed to improving users’ experience. You may be provided with Software/Content updates from time to time during this EULA. The software may collect personal information from you, but it will not disclose or share your information for illegal use or without seeking your agreement.
Restrictions of License
You shall use this Software according to the terms of this Agreement and shall not:
- Permit any third party to decompile/reverse engineer/disassemble the Software, whether it is directly or indirectly;
- Modify, adapt, improve, translate, create derivative works from the Software;
- Access or use the Software in violation of laws, regulations, or third-party rights;
- Remove or modify any proprietary notices, trademarks, copyright markings, or labels from the Software;
- Sell, lease, rent, sublicense, distribute, assign, or transfer the Software or any copies of it without the prior written consent of FoneShare.
Transfer Restrictions
You shall not transfer or assign rights to others without the prior written consent from FoneShare under this Agreement.
Warranty Disclaimer
FoneShare does not fully warrant the suitability, completeness, accuracy, or reliability of any materials, content, or information, and disclaims liability for errors and omissions therein. You assume sole responsibility for selecting, operating, and managing the Software, as well as any outcomes resulting from its use. Improper use of the Software, including actions contrary to provided instructions, may result in damage to your devices (e.g., smartphones, tablets, computers, or cloud storage systems) or operating platforms (e.g., iOS, Android, Windows, macOS). Such misuse may also lead to unintended data loss. You bear all risks related to the performance, quality, and outcomes of the Software.
Disclaimer of Consequential Damages
During the use of this Software, FoneShare takes no responsibility for any consequential damages.
Limitation of Liability
FoneShare bears no responsibility for damages related to the use of this Software. FoneShare is not liable for any illegal content you have shared/downloaded via FoneShare software. Foneshare is not liable for any data loss resulting from inaccurate use of FoneShare software.
If any third party claims that the Software infringes its intellectual property rights, FoneShare will take prompt measures to address the claim, including providing a modified or replacement version of the Software at no additional cost to you.
Termination
FoneShare reserves the right to terminate this Agreement if you violate the terms.
You may terminate this Agreement at any time. In that case, you shall return all the copies of FoneShare products or destroy them.
Export Restrictions
You shall not use, import, or export the product to countries or areas sanctioned by the USA or the United Nations. You shall bear the full responsibility for the use, export, and import actions. You shall ensure full compliance with the law.
Miscellaneous
You are not allowed to use products/services of FoneShare that violate the local law or infringe on others’ intellectual property rights. By using the products/services, you assume sole responsibility for compliance with applicable laws and rights. FoneShare shall not be held liable for any claims or damages arising from your use. If you do not agree to these terms, you must not download, install, or use the products/services.
